1. Acceptance of Terms

The website operated at arq-wellness.com, the ARQ INC. booking platform, studio facilities, and any related services, content, communications, programs, or offerings made available from time to time (collectively, the “Services”) are operated by ARQ INC. (“ARQ INC.,” “we,” “us,” or “our”).

By accessing our website, creating an account, booking a service, purchasing a membership, class pack, private session, recovery session, event booking, attending the studio, or otherwise using ARQ INC. Services, you (“you,” “client,” or “user”) confirm that you have read, understood, and agree to be bound by these Terms & Conditions.

These Terms & Conditions apply together with the ARQ INC. Privacy Policy and Liability Waiver & Assumption of Risk.

Please review this agreement carefully, as it contains important information regarding your rights, responsibilities, obligations, payment terms, cancellation policies, assumptions of risk, limitations of liability, and conditions related to your use of ARQ INC. Services.

If you do not agree to these Terms & Conditions, you must not access or use ARQ INC.’s website, booking platform, facilities, or services.

ARQ INC. reserves the right to update or modify these Terms & Conditions at any time. Continued use of ARQ INC. Services after updates constitutes acceptance of the revised Terms.

2. Services Offered

ARQ INC. provides wellness, fitness, and lifestyle services including, but not limited to:

  • Reformer Pilates

  • Mat Pilates

  • Yoga

  • Private Pilates sessions

  • Workshops and specialty classes

  • Mommy & Me and parent-child classes

  • Sauna

  • Cold plunge

  • Compression therapy

  • Recovery services

  • Private events

  • Studio rentals

  • Community events and experiences

Service availability may vary and is subject to change.

3. Eligibility & Age Requirements

Clients must provide accurate account information and comply with all ARQ INC. policies.

Recovery services including sauna, cold plunge, and compression therapy are restricted to clients 18 years of age or older.

Clients under 18 may participate in approved classes with parent or guardian consent.

ARQ INC. reserves the right to request identification or deny access where eligibility requirements are not met.

4. Pricing, Purchases & Payments

Current pricing, membership benefits, class pack details, introductory offers, promotional offers, and service inclusions are displayed on the ARQ INC. website and/or booking platform at the time of purchase.

Pricing and offerings may be modified by ARQ INC. from time to time without requiring an amendment to these Terms & Conditions.

All purchases must be paid through the approved ARQ INC. payment methods.

Applicable taxes will be applied where required.

5. Refund Policy

All purchases are final sale unless otherwise required by law.

This includes, but is not limited to:

  • memberships

  • class packs

  • drop-ins

  • introductory offers

  • private sessions

  • recovery bookings

  • event deposits

  • retail purchases

Purchases are non-refundable, non-transferable, and may not be shared between clients.

6. Membership Terms

ARQ INC. offers various memberships with benefits and inclusions outlined at the time of purchase.

Membership benefits may include access to classes, booking privileges, recovery services, guest privileges, or other benefits depending on membership type.

Memberships are personal to the purchaser and cannot be transferred, shared, or assigned.

Unlimited memberships permit one (1) class booking per calendar day unless otherwise specified.

7. Founding Memberships

Founding memberships are promotional memberships offered for a limited time.

Founding rates are maintained only while the membership remains:

  • active

  • in good standing

  • compliant with ARQ INC. policies

If a founding membership is cancelled, terminated, or allowed to lapse, the founding rate may not be reinstated.

8. Membership Commitment & Cancellation

Memberships require a minimum commitment period of three (3) months unless otherwise stated.

After completion of the minimum commitment period, memberships may be cancelled with thirty (30) days written notice.

Early cancellation before completion of the minimum commitment period is subject to a $75 early termination fee.

Memberships automatically renew until cancelled according to this policy.

9. Membership Freeze Policy

Memberships may be placed on hold for travel, medical reasons, or personal circumstances.

Freeze terms:

  • Minimum freeze: 14 days

  • Maximum freeze: 60 days per calendar year

  • 7 days written notice required

  • Freezes cannot be applied retroactively

Billing automatically resumes once the freeze period ends.

Founding memberships may be frozen once per calendar year subject to the maximum freeze allowance.

10. Failed Payments

A $20 failed payment fee may apply to declined, expired, or unsuccessful payments.

ARQ INC. reserves the right to suspend:

  • memberships

  • booking privileges

  • account access

  • studio access

until outstanding balances are resolved.

11. Class Packs & Introductory Offers

Class packs, drop-ins, and introductory offers are subject to the expiration dates and terms displayed at the time of purchase.

Class packs and promotions:

  • cannot be shared

  • cannot be transferred

  • cannot be refunded

  • cannot be extended unless approved by ARQ INC.

Introductory offers are available to new clients only unless otherwise specified.

12. Booking Policy

All classes and services must be booked through the ARQ INC. booking platform.

Booking windows may vary by membership type and are subject to change.

Clients are responsible for:

  • booking correctly

  • managing reservations

  • monitoring confirmations

  • cancelling within required windows

13. Waitlist Policy

Waitlists operate through the ARQ INC. booking platform auto-fill system.

Clients added from the waitlist are responsible for attending or cancelling according to cancellation policies.

14. Cancellation, Late Cancel & No-Show Policy

Classes must be cancelled at least 6 hours before the scheduled start time.

Fees:

Late cancellation: $20
No-show: $30

Repeated late cancellations or no-shows may result in booking restrictions or account review.

15. Late Arrival Policy

Clients arriving more than 5 minutes late may not be permitted entry.

Classes include:

  • warm-up

  • safety instructions

  • equipment setup

  • movement preparation

  • class progression

Missing the beginning of class may impact client safety and disrupt the experience of others.

Refunds or credits are not provided for late arrivals.

16. Studio Rules

Clients agree to:

  • wear grip socks for Reformer Pilates

  • follow instructor guidance

  • use equipment safely

  • respect staff and other clients

  • maintain appropriate studio conduct

  • avoid phone use during class

  • follow posted policies

Children are permitted only during designated parent-child programming.

Pets are not permitted except service animals as required by law.

17. Instructor & Schedule Changes

ARQ INC. reserves the right to modify:

  • instructors

  • class schedules

  • operating hours

  • amenities

  • services offered

at any time.

Instructor substitutions or schedule adjustments do not qualify for refunds or compensation.

18. Recovery Services

Recovery services are booked in 60-minute reservation blocks and may include:

  • sauna

  • cold plunge

  • compression therapy

Recommended use guidelines:

Sauna: approximately 15–20 minutes maximum
Cold plunge: short exposure, generally 1–5 minutes
Compression therapy: approximately 15–30 minutes

Clients must follow posted safety instructions.

19. Recovery Service Restrictions

Clients should seek medical clearance before using recovery services if they:

  • are pregnant

  • have heart conditions

  • have blood pressure concerns

  • have circulation issues

  • have diabetes

  • have seizure disorders

  • recently had surgery

  • have injuries

  • experience fainting/dizziness

  • have heat or cold sensitivity

  • have medical concerns impacted by heat, cold, or compression

Recovery services must not be used while under the influence of alcohol, cannabis, recreational drugs, or impairing substances.

20. Private Events & Studio Rentals

A 50% non-refundable deposit is required to secure private events.

Cancellations within 14 days of the event date result in forfeiture of the deposit.

Clients booking events are responsible for:

  • guests

  • damages

  • excessive cleaning

  • policy violations

  • missing items

Alcohol may be permitted only at approved private events and must comply with applicable Ontario laws.

ARQ INC. reserves the right to end events or remove guests for safety concerns or policy violations.

21. Guest Privileges

Guest benefits included with eligible memberships:

  • are subject to availability

  • must follow booking policies

  • are non-transferable

  • do not roll over unless stated otherwise

Guests must follow all ARQ INC. policies and complete required waivers.

22. Retail Purchases

Retail purchases are final sale unless otherwise approved by ARQ INC. or required by law.

23. Media Release

Photography and video may occur inside ARQ INC. facilities for:

  • marketing

  • advertising

  • social media

  • promotional materials

  • brand content

Clients who do not wish to appear in identifiable content must notify ARQ INC. in writing before participation.

Reasonable efforts will be made; however, ARQ INC. cannot guarantee exclusion from background or group content.

24. SMS/Text Messaging Terms

Program Description

By opting in, you agree to receive recurring automated text messages from ARQ INC. (“we,” “us,” “our”) at the mobile number you provided.

Messages may include:

  • appointment reminders

  • class confirmations

  • waitlist notifications

  • schedule updates

  • account alerts

  • promotional offers

  • customer support follow-ups

  • studio communications

Consent to receive these messages is not a condition of any purchase.

Message Frequency

You may receive recurring messages.

Message frequency may vary depending on your activity, bookings, account settings, and interactions with us.

Message and Data Rates

Message and data rates may apply.

Charges are billed by and payable to your mobile service provider.

Please contact your wireless carrier for details about your messaging plan.

How to Opt Out and Get Help

You can unsubscribe from the SMS service at any time by replying STOP to any message we send you.

After you send STOP, you will receive a one-time confirmation message, and no further messages will be sent.

If you want to rejoin, you can sign up again using the original opt-in method or reply START.

25. Privacy Policy

ARQ INC. collects, stores, and uses personal information according to the ARQ INC. Privacy Policy.

26. Right to Refuse Service

ARQ INC. reserves the right to refuse service, suspend accounts, restrict bookings, or terminate memberships due to:

  • non-payment

  • unsafe behaviour

  • harassment

  • inappropriate conduct

  • misuse of facilities

  • repeated policy violations

  • violation of these Terms

27. No Medical Advice

All content, information, guidance, recommendations, or materials provided by ARQ INC., including through the website, booking platform, social media, emails, studio materials, instructors, staff, classes, or wellness services, is provided for general informational, fitness, and wellness purposes only.

ARQ INC. does not provide medical advice, diagnosis, treatment, or healthcare services.

Participation in ARQ INC. services is voluntary. Clients are responsible for determining whether participation is appropriate for their individual health, fitness level, and circumstances.

Clients should consult a qualified healthcare professional regarding medical conditions, injuries, pregnancy, health concerns, or questions before participating.

Reliance on any information provided by ARQ INC. is solely at the client’s own discretion and risk.

28. Liability Waiver Requirement

Participation in ARQ INC. services requires acceptance of the ARQ INC. Liability Waiver & Assumption of Risk.

Clients must complete required waiver acknowledgment before participating.

29. Governing Law

These Terms & Conditions are governed by the laws of the Province of Ontario and applicable laws of Canada.
